EVS IMAGING NOTICE OF PRIVACY PRACTICES
HIPAA + Arizona Medical Record Privacy
Effective Date: August 11, 2026
This notice describes how medical information about you may be used and disclosed, how you can get access to this information, and your privacy rights. Please review it carefully.
Your Rights
• Get a copy of your medical record. You may ask to see or obtain an electronic or paper copy of your medical record and other health information we maintain about you. We will provide access as required by law and may charge a reasonable, cost-based fee when permitted.
• Ask us to correct your record. You may ask us to correct health information you believe is incorrect or incomplete. We may deny the request in certain circumstances and will explain a denial when required.
• Request confidential communications. You may ask us to contact you in a specific way or at a specific location. We will accommodate reasonable requests as required by law.
• Ask us to limit what we use or share. You may request restrictions on certain uses or disclosures. We are not required to agree to every request. If you pay in full out of pocket for a service, you may ask us not to share information about that service with your health plan for payment or health care operations, and we will comply unless disclosure is required by law.
• Get an accounting of certain disclosures. You may ask for an accounting of certain disclosures of your health information for the six years before your request, subject to exclusions permitted by law.
• Get a copy of this notice. You may request a paper or electronic copy at any time.
• Choose someone to act for you. A legally authorized personal representative may exercise your privacy rights on your behalf after we verify that person's authority.
• File a complaint. You may complain to EVS Imaging or to the U.S. Department of Health and Human Services Office for Civil Rights if you believe your privacy rights were violated. We will not retaliate against you.
Your Choices
For certain health information, you may tell us your preferences about what we share. For example, when applicable, you may tell us whether we may share information with family, friends, or others involved in your care or in disaster-relief situations. If you are unable to tell us your preference, we may share information when we believe it is in your best interest and the law permits it. We will obtain your written authorization for uses and disclosures that require authorization under HIPAA, including most uses of psychotherapy notes, certain marketing communications, and a sale of PHI. You may revoke an authorization in writing, except to the extent we already acted in reliance on it.
How We May Use and Share Your Information
• Treat you. We may use and share your information with physicians and other health professionals involved in your care, including sending vascular ultrasound images, measurements, findings, and reports to your ordering or treating provider.
• Run our organization. We may use and share information for health care operations such as quality assessment, compliance, credentialing, auditing, staff training, business management, and improving our services.
• Bill for services. We may use and share information with health plans and others to bill and obtain payment for services.
• Work with business associates. We may share information with vendors and contractors that perform services for us when permitted by law and, when required, subject to agreements requiring appropriate safeguards.
• Help with public health and safety. We may share information for certain public-health activities, reporting obligations, product recalls, preventing or reducing a serious threat, and other purposes permitted by law.
• Comply with law and government requests. We may share information when required or permitted for health oversight, workers' compensation, law enforcement, judicial or administrative proceedings, coroners/medical examiners, organ donation, and other legally authorized purposes.
Substance Use Disorder Records
To the extent EVS Imaging creates, receives, or maintains substance use disorder patient records that are protected by 42 CFR Part 2, those records receive the protections required by federal law. Such Part 2 records may not be used or disclosed in civil, criminal, administrative, or legislative proceedings against the patient without the patient's written consent or a court order meeting applicable federal requirements, except as otherwise permitted by law.
Arizona Privacy Protections
Arizona law generally provides that medical records, payment records, and the information contained in those records are privileged and confidential. EVS Imaging will disclose such information only as authorized or required by applicable Arizona or federal law or pursuant to an appropriate written authorization when authorization is required. If an applicable Arizona law provides greater privacy protection than HIPAA, EVS Imaging will follow the more protective requirement.
Our Responsibilities
We are required by law to maintain the privacy and security of your protected health information, follow the duties and privacy practices described in the notice currently in effect, provide you with a copy of this notice, and notify you following a breach of unsecured protected health information when notification is required by law. We will not use or share your information other than as described here unless you authorize us in writing or the law permits or requires the use or disclosure.
Changes to This Notice
We may change the terms of this notice as permitted by law. Changes may apply to information we already have as well as information we receive in the future. The current notice will be available upon request, at our office, and on our website.
